Norway's migration to digital audio broadcasting (DAB) does not breach EEA rules. This is the conclusion of the EFTA Surveillance Authority (ESA), which today closes a complaint case concerning the coordinated switchover to digital radio in Norway.
ESA received a complaint in December of 2015, alleging that switching the analogue FM radio network off and introducing DAB technology for radio broadcasting in Norway amounts to a breach of EEA law.
In 2017, Norway brought the distribution on the FM network of national commercial radio channels and commercial local radio channels in the four largest cities to an end. Local radio broadcasting on the FM network outside these cities remains unaffected to date.
In its assessment, ESA concludes that it falls within the discretion of the EEA States to decide on the national migration from analogue to digital broadcasting, as long as effective management of the radio frequency spectrum is ensured and it is based on objective, transparent and non-discriminatory criteria.
In doing so, a State may pursue legitimate audio-visual policy objectives, such as the promotion of greater competition, increased media pluralism, and greater choice of content. Norway's coordinated digital switchover from FM to DAB radio is in keeping with its EEA obligations.
